Maurice Wutscher’s Donald Maurice Speaks to MarketWatch About Post-Judgment Interest on Debt

Dec. 16, 2021 — Maurice Wutscher partner Donald Maurice was quoted in a recent MarketWatch article about post-judgment interest rates on outstanding debt owed by consumers.

Mr. Maurice, who is legal counsel for Receivables Management Association International, said RMAI’s members “don’t sit on judgments and any interest that would accrue on them during the intervening period wouldn’t offset collection costs.”

“’Persons who have judgments against them are financially distressed, the problem is not trying to collect more on the judgment, the problem is trying to collect any amount,’ he said. ‘It just doesn’t make sense that anyone who is practicing good compliant business practices is going to want to sit on judgments to accrue interest.’”

Maurice Wutscher’s Ralph Wutscher Named American Bar Foundation Fellow

Dec. 15, 2021 — Maurice Wutscher partner Ralph Wutscher has been named a Fellow of the American Bar Foundation.

The Fellows of the American Bar Foundation is a global honorary society of attorneys, judges, law faculty and legal scholars whose public and private careers have demonstrated outstanding dedication to the highest principles of the legal profession and to the welfare of their communities.

Membership in the Fellows is limited to one percent of lawyers licensed to practice in each jurisdiction. Fellows are nominated by their peers and elected by the Board of the American Bar Foundation.

Ralph Wutscher focuses his practice primarily on representing consumer and commercial financial services companies, including depository and non-depository mortgage lenders, fintech companies of various kinds, credit card issuers, and loan servicers, as well as financial asset buyers and sellers, and other financial services providers. He also has substantial experience representing depository and non-depository auto finance companies. He represents the lending and financial services industry as a litigator, and as regulatory compliance counsel.

Sept. 2, 2021 — Maurice Wutscher attorney Donald Maurice will join a panel in examining changes to legislation passed by the District of Columbia City Council in July to amend its debt collection law during an RMAI webinar Friday, Sept. 3 at 12 pm ET.

The District of Columbia’s debt collection legislation becomes effective Sept. 23 and imposes significant requirements for data and documentation as well as restrictions on consumer contact. The legislation has undergone substantive changes since it was introduced in July.

The panelists, including Mark Naiman of Absolute Resolutions Corp. and Franci Wayland of PRA Group, will discuss the latest changes and amendments to the legislation and potential compliance strategies companies can implement to address these changes.

July 19, 2021 — Maurice Wutscher attorneys Donald Maurice and Eric Rosenkoetter will join a panel in examining emergency legislation passed by the District of Columbia City Council last week to amend its debt collection law during an RMAI webinar Tuesday, July 20 at 1 pm ET.

On July 13, the City Council passed the emergency legislation, which will take effect when signed by D.C.’s mayor. A “temporary” bill was also introduced that contains the same provisions.

Maurice Wutscher’s Alan Hochheiser Examines Consumer Bankruptcy Trends During the Pandemic in Business Law Today

July 7, 2021 — Maurice Wutscher bankruptcy practitioner Alan Hochheiser has written an article for the American Bar Association’s news magazine Business Law Today in which he takes a closer look at consumer bankruptcy developments during the COVID-19 pandemic including filing trends, Supreme Court cases, proposed legislation and the arena of consumer protection cases in bankruptcy proceedings.

In “Consumer Bankruptcy in the Age of COVID-19,” he writes, “The last year and half was a time to be remembered in Bankruptcy Law. It started with an eye on increasing the ability of small businesses to utilize the Chapter 11 process in a more efficient and less expensive way, which led to record number of commercial filings, a reduction in consumer filings, and a test of the bankruptcy system.”

“Six months into 2021, we have not seen the feared tsunami of consumer bankruptcy filings. Bankruptcy courts are not overwhelmed. This lack of an increase in bankruptcies could extend for a substantial period of time as businesses reopen, COVID restrictions are released, consumers begin to spend and travel, and certain states and the government look to resume foreclosure and eviction moratoriums. We optimistically wait to see what the second half of 2021 brings,” he writes.
