Maurice Wutscher Attorneys to Speak at NARCA Meeting

May 3, 2016 — Several Maurice Wutscher attorneys will speak on recent developments in consumer financial services law at NARCA’s Spring Conference in Chicago this week.

Donald Maurice and Eric Rosenkoetter will be panel speakers for “Auto Deficiency, Replevin, Medical, and Foreclosure FDCPA Issues You Won’t See With Credit Cards.” The presentation will take a closer look at FDCPA claims arising from practices unique in the servicing and collection of mortgage and student loans, the collection of government debt, motor vehicle loans and medical debt. Panelists will discuss current case law and best practices to reduce liability when engaged in representing clients in these specialized areas.

Thomas R. Dominczyk will discuss “Bankruptcy for Collection Attorneys.” Dominczyk will examine the impact of bankruptcy on outside collection efforts, claim filing and management, and potential FDCPA applicability for actions within bankruptcy.

Brent Yarborough will moderate “Regulation of the Collection Industry: How Much is Too Much?” Representatives from the Cato Institute, the CFPB, the University of Virginia School of Law, the Office of the Illinois Attorney General, and the FTC will participate in this panel discussion.

Maurice discusses actions involving the Electronic Fund Transfer Act and whether a favorable U.S. Supreme Court decision in Spokeo Inc. v. Robins may curtail their filings by imposing stricter standing requirements.

He points out that Spokeo only deals with whether ‘noinjury’ plaintiffs have standing to sue in federal court. No matter what happens, plaintiffs can still bring EFTA cases in state court. The statute explicitly states that federal courts and state courts have concurrent jurisdiction.”

Maurice Wutscher’s Patrick Kane Appointed a Hearing Officer of Calif. Horse Racing Board

patrickKane-1Nov. 18, 2015 — Patrick Kane, an associate in the San Diego office of Maurice Wutscher, has been appointed to serve the California Horse Racing Board as a hearing officer.

Mr. Kane will assist the board in ensuring the integrity and safety of the racing industry. He will conduct and oversee hearings, adjudicate decisions and issue findings of fact and conclusions of law.

In his equine practice, Mr. Kane focuses on the representation of industry participants at administrative hearing and appeals, purchase and sale agreements, partnership and limited liability creation, gaming law, regulatory matters, and equine-related negligence actions.

Mr. Kane graduated from the University of San Diego School of Law. He obtained his undergraduate degree from the University of Arizona where he majored in Animal Science and was a graduate of the Race Track Industry Program. There, he received the Mildred Vessels Scholarship Award and the Race Track Industry Program’s Scholarship Award.

Maurice Wutscher Attorneys to Speak at Consumer Financial Services Conference

Nov. 4, 2015 — Maurice Wutscher attorneys will discuss the Telephone Consumer Protection Act, mortgage servicing, and attorney ethics at the Consumer Financial Services Conference at Loyola University Chicago School of Law.

Ernest Wagner will share his experiences in TCPA litigation on Nov. 19. Ralph Wutscher will lead a panel discussion on mortgage servicing issues on Nov. 20 and Donald Maurice will present on attorney ethics for financial services lawyers the same day.

Donald Maurice to Speak at Institute on Consumer Financial Services Basics

Sept. 24, 2015 — Maurice Wutscher attorney Donald Maurice will present on the latest issues in consumer bankruptcy and Fair Debt Collection Practices Act litigation at the Sixth Annual National Institute on Consumer Financial Services Basics on Oct. 8-9 in Arlington, VA.

The two-day program provides attorneys with up to 14 CLE credit hours and is presented by the Consumer Financial Services Committee of the American Bar Association’s Business Law Section and the Center for Professional Responsibility.

Maurice Wutscher Opens Austin Office, Adds Attorney Eric Rosenkoetter

ericrosenkoetterAug. 5, 2015 — National financial services law firm Maurice Wutscher LLP has opened a new office in Austin, hiring financial services attorney Eric Rosenkoetter to lead the firm’s Texas litigation matters in its Austin office.

Mr. Rosenkoetter will practice in the firm’s Commercial Litigation, Consumer Credit Litigation and Regulatory Compliance groups, joining Maurice Wutscher’s skilled team of attorneys focused on defense of the financial services industry in offices throughout the United States.

Mr. Rosenkoetter has substantial experience as a litigation attorney and also brings a solid background as a compliance and transactional attorney for the financial services industry. In that role, he has provided strategic, business growth, legislative, compliance and regulatory advice to national corporations and trade associations. For example, he has drafted consumer contracts and disclosures designed to state-specific statutory requirements, and developed “Best Practices” guides and state-by-state compliance grids, for national financial services companies. He also conducted research and crafted a metrics report for a national trade association with analysis designed to counter the claims of advocacy groups.

Mr. Rosenkoetter’s experience also includes working for a national corporation as executive counsel, chief compliance and ethics officer, and director of legislative affairs, and as a federal lobbyist and director of government and public affairs for a national financial services trade association. In the government sector, he presided over approximately 6,000 state administrative hearings, served as a staff attorney for the Missouri Senate, and handled litigation in 33 counties as a regional managing attorney.

Mr. Rosenkoetter earned his Juris Doctor from Washington University School of Law, and his Bachelor of Business Administration from Southern Methodist University. He is admitted to practice law in Texas and Missouri.
